Terms Of Reference
AS APPROVED AT THE NCRC ANNUAL GENERAL
MEETING
(May 5 and 6, 2001)
A. General
1. From time to time, funds are collected
or allocated by the National Capital
Region Council (NCRC) to provide financial assistance
to Public Service Alliance of Canada (PSAC) members. In
order to secure these funds, the Council has established
a Membership Benefit Fund with a Board of Trustees to administer
these monetary resources. In addition, the Council has prepared
regulations governing the operation of this Fund which are
in compliance with PSAC Regulation 6A and Section 25 (5)
(j) of the PSAC Constitution.
B. Officers of
the Board of Trustees
2. The Membership Benefit Fund Board of Trustees
shall consist of a Chairperson, Vice Chairperson, and Secretary
Treasurer. The Treasurer of the National Capital Region
Council shall be the Chairperson. The Vice-Chairperson and
Secretary-Treasurer shall be elected at the Annual General
Meeting of the NCR Council in accordance with the NCRC
Bylaws and Regulations.
3. The Secretary-Treasurer shall be responsible
for maintaining up-to-date administrative and financial
records.
4. The signing officers shall be the Chairperson,
Vice-Chairperson, and Secretary-Treasurer. All cheques shall
require the signature of two of these officers.
5. A quorum shall consist of two members of
the Board of Trustees.
6. Meetings of the Board shall be held as
required.
7. Financial records shall be maintained and
up-to-date at all times and be available to the NCRC Standing
Finance Committee, the Regional Executive Vice-President,
NCR, as well as to the Alliance Executive Committee.
C. Revenues
8. All revenues must be deposited in a chartered
bank, trust company or credit union account in the name
of the MEMBERSHIP BENEFIT FUND OF THE PSAC NATIONAL CAPITAL
REGION COUNCIL. Under NO circumstances shall funds be disbursed
in form of a cash payment.
9. A Financial Statement complete with all
revenues and expenditures for the period 1 January through
31 December will be presented at the National Capital Region
Council's Annual General Meeting. While protecting
the public identity of those receiving help, it will be
necessary to identify all revenues and disbursements in
a manner that meets the requirements of both the Council's
Standing Finance Committee and the Council's Auditor.
In addition, this financial statement must be forwarded
through the Regional Executive Vice President for the NCR
to the National President of the PSAC. This statement shall
be accompanied with the account name, branch and account
number of the financial institution where the Fund's
monies are deposited.
D. Disbursements
10. All disbursements from the Fund shall
be by cheque from a chartered bank, trust company or credit
union account.
11. Disbursements may be made:
i) directly to the member(s);
ii) to a welfare committee established in accordance with
the PSAC strike manual, or
iii) to a strike coordinator, at any level, as defined in
the PSAC strike manual.
12. Disbursements may be in the from of:
i) direct grants;
ii) payment on behalf of, or
iii) loans with or without interest
13. The Board of Trustees shall respect the
confidentiality of individual recipients and shall not disclose
individual's name or particulars.
14. The Board of Trustees shall maintain records
of all disbursements in such a manner as is acceptable for
audit purposes and to ensure the expenditures are legitimate.
15. In the case of an individual who fails
to repay a loan as scheduled, the Board of Trustees may
disclose the individual's name to those who should
be made aware of the situation.
